Specialty hospital construction would be held up for 18 months under a provision in the Medicare reform proposal before Congress. Thanks to intense lobbying by hospital trade groups, lawmakers agreed to a moratorium on construction while Congress studies whether such institutions hurt general hospitals by luring away the most profitable patients.... Health plan liability could be greatly increased thanks to two lawsuits that the U.S. Supreme Court has agreed to hear. Two related cases — Aetna Health v. Davilla and Cigna v. Calad et al. — test whether administrative decisions are protected from state lawsuits under ERISA provisions.
